Voltas, a popular Indian Home appliances brand has secured injunction against a maleficent domain name. The counterfeit domain name was trying to mimic itself as Voltas and was trying to dupe customers.
Voltas Limited had filed a complaint against the domain name MyVoltasCare.com. The Complaint was adjudicated at the Delhi High Court. The Plaintiff claimed trademarks over VOLTAS since 1954. The Plaintiff argued that the Defendant incorporated their trademarks into their own and thus infringed upon their registered marks. The Plaintiff presents that the mark was a coined name, devoid of any possible generic nature.
The Court found that this was indeed the case that the Defendant Ashok Kumar had infringed upon the Plaintiff trademarks. Not only that, the Defendant even copied the logo, fonts and appearance of the Plaintiff. This clearly indicates that the Defendant intended to lure users by presenting itself as the Voltas brand.
The Court granted injunction against the Defendant from any further usage of the Plaintiff’s concerned trademarks. The Disputed domain was blocked as well.
