Cannawayz Inc. is an American Company dealing with Cannabis. The company manages a Cannabis directory for businesses as well as individual users.
The company was distressed over the usage of a domain name CannaWays.com. The Company claimed that the domain name was similar to its domain name and trademarks. The Company thus filed a Complaint over the domain name at WIPO.
The Complainant presented a word trademark as well as logo trademark registered in the US in April 2019 and June 2019 respectively, belonging to CANNAWAYZ. The Complainant operates on the domain name CannaWayz.com.
The Respondent claims that he registered the domain name November 2014. The Complainant contests this and presents that the domain name was registered in 2019 as is shown in WhoIs record with the Registration belonging to Oregon Fair Trade Cannabis, the Respondent’s company.
The panel found that it was more likely that the domain name was registered in 2014. The respondent also claimed that the inclusion of Oregon in the registrant detail was a mistake. The panel pointed that even if the domain name was registered in 2019, the Complainant failed to establish its presence before April 2019.
Based on these pacts, the panel denied the Complaint.
