Domainer with several ‘doc’ related domain names had to forego KidiDoc.com

Société Librairie Fernand Nathan-Fernand Nathan & Cie is a French company that engages in publishing, education, games, and TV programs. The Company found its trademark violated through the use of domain name KidiDoc.com. The company thus filed a Complaint at WIPO. 

The Complainant has French trademark rights over the KIDIDOC mark, registered in 1999. The Complainant along with it, also possesses the domain name KidiDoc.fr, which redirects to its official website at site.Nathan.fr.

The disputed domain name was registered in June 2012. The domain name was put up for sale by the Respondent at a price of $9,888. The Respondent claims that bad faith on his part couldn’t be established as the domain names were registered for the legitimate purpose of investment. The Respondent noted that the domain name was acquired on a pattern where he registered several ‘Doc’ related domain names. These include GlassDoc.com, MotoDoc.com, BlogDoc.com, EduDoc.com, etc.

The panel pointed out how made-up words were highly distinctive owing to its uniqueness. The panel pointed out that the Respondent was charging a hiked price for the domain name. The panel stated that the only reason for such a hefty price is its association with the Complainant. 

The registration was decided to be in bad faith and the domain name was transferred.
